Terms of Service

Note: This is a translation provided for your convenience. The Dutch (Nederlands) version of this document is legally binding in case of any discrepancy or interpretation difference.

1. Definitions

Daviq: trade name registered with the Dutch Chamber of Commerce under number 57725381, located at Atoomweg 63, 3542AA Utrecht, the Netherlands.

User: any natural or legal person who uses the services of Daviq.

Services: all software products, mobile applications, web applications and related services offered by Daviq.

2. Applicability

These terms apply to all use of Daviq services, including visiting the website, using applications and creating an account. By using our services, you agree to these terms.

Daviq may amend these terms. Material changes will be communicated via the website at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the amended terms.

3. Use of Services

• You may only use our services for lawful purposes and in accordance with these terms.
• You are responsible for keeping your account credentials confidential.
• It is not permitted to use our services in a manner that causes harm to Daviq or third parties.
• Reverse engineering, decompilation or disassembly of our software is not permitted.
• Automated access (scraping, bots) without written permission is not permitted.

4. Beta Software

Daviq may offer certain services in beta version. The following additional terms apply to beta software:

• Beta software is provided "as is" without warranty of completeness, stability or availability.
• Data entered in beta versions may be lost during updates or after the conclusion of the beta programme.
• Daviq is not liable for any damage arising from the use of beta software.
• Participation in a beta programme may be terminated by either party at any time.

5. Intellectual Property

All intellectual property rights in the services, including software, designs, texts, images and trademarks, belong to Daviq or its licensors. Nothing in these terms transfers any intellectual property right to the user.

6. Availability

Daviq strives for high availability of its services but does not guarantee uninterrupted or error-free access. Daviq is not liable for any damage resulting from temporary unavailability, maintenance or technical failures.

7. Liability

Daviq liability is limited to direct damages and amounts to a maximum of the amount paid by the user to Daviq in the 12 months preceding the event giving rise to the damage for the relevant service.

Daviq is not liable for indirect damages, consequential damages, lost profits or loss of data.

8. Force Majeure

Daviq is not liable for failure to perform obligations due to circumstances beyond its control, including but not limited to hosting, internet or telecommunications disruptions, cyber attacks, government measures or natural disasters.

9. Age Restriction

Our services are intended for persons aged 16 and over. By using our services, you confirm that you are at least 16 years of age.

10. Applicable Law and Disputes

Dutch law applies to these terms. Disputes are exclusively submitted to the competent court in Utrecht, the Netherlands.
